Juvenile traffic cases
If a youth has been cited for a misdemeanor traffic violation, the case will be handled informally by the Probation Department without a petition being filed (PEI). Certain misdemeanor violations involving a vehicle, such as driving under the influence, are reviewed by the District Attorney. A public defender only represents youth for traffic violations when the District Attorney files a petition with the court.
If a youth has been cited for a traffic infraction, the case will be handled by the County of Santa Clara Traffic Court.
Depending on the type of traffic offense and the youth’s driving history, the outcome of the traffic infraction can vary. The Traffic Commissioner may dismiss the citation, order the youth to attend and complete California Highway Patrol’s “Start Smart” class or other traffic school, or require community service. The Traffic Commissioner considers the youth’s age, nature of violation, and past and current driving history in determining the appropriate consequence.
